CONSUMER TERMS & CONDITIONS OF SALE (ANZ)

1 – Who We Are
For customers purchasing products from our Australia and New Zealand website, products are sold by AKT London Pty Ltd, a company incorporated in Australia, with its registered office at AKT London Pty Ltd, ℅ PKF, Level 8, 1 O'Connell Street, Sydney NSW 2000, Australia (the “ANZ Store”).
AKT London Limited operates the website and provides customer service, returns handling and other support services to the ANZ Store.
All references to “AKT”, “we”, “us”, “our” shall be to AKT London Pty Ltd or AKT London Limited as relevant.

2 – Scope of These Terms
These Terms apply only to individual consumers purchasing products for personal use through the ANZ Store.
If you are purchasing products in the course of business, separate business terms will apply.
Nothing in these Terms excludes, restricts or modifies any mandatory rights you have under the Australian Consumer Law or the New Zealand Consumer Guarantees Act.
3 – Eligibility & Customer Information
To place an order, you must:
a) Be legally capable of entering into a contract (or have parental consent); and
b) Provide complete, accurate and up-to-date information.
You are responsible for ensuring that your delivery and contact details are correct. We are not responsible for delivery failures caused by incorrect information.
4 – How the Contract Is Formed
When you place an order, you are making an offer to purchase products from us.
You will have the opportunity to review and correct your order before checkout.
A binding contract is formed only when we send you an order confirmation email.
We may decline or cancel an order if, for example, payment fails or there is a reasonable issue with the order. If we do, you will not be charged.
5 – Products
We make every reasonable effort to ensure that products are accurately described and displayed on our websites.
Minor variations may occur due to screen display, lighting, or production batches.
6 – Prices, Taxes & Payment
Prices are shown in AUD or NZD (depending on your location) and include GST where applicable.
Delivery costs are shown separately before checkout.
Payment is taken at checkout using the available payment methods.
Where an order is shipped from outside the destination country, additional charges such as:
a) customs duties,
b) import taxes,
c) GST, or
d) carrier handling fees
may apply. These charges are set by local authorities or carriers and are outside our control. You are responsible for paying any such charges. We are not responsible for delays caused by customs clearance processes.
7 – Delivery
Delivery times are estimates only and may be affected by factors outside our control, including carrier delays or other logistics issues.
We deliver to the address you provide at checkout. You are responsible for ensuring that the delivery address is accurate and suitable for receipt of the order.
We do not accept liability for delivery failures arising from an order being addressed to a PO box, hotel, forwarding service, temporary address, or any other location where delivery or receipt may be restricted or unreliable.
8 – Damaged, Faulty, Incorrect or Missing Items
If your order arrives damaged, faulty, incomplete or otherwise incorrect, please notify us promptly via our Help Centre so we can investigate and resolve the issue.
If a product has a major failure, you may be entitled to a replacement, refund or other remedies under Australian or New Zealand consumer law.
Normal wear to outer packaging or natural oxidation of components does not count as product damage.
9 – Voluntary Returns & Refunds
We offer a voluntary 30-day goodwill return period from the date you receive your order, allowing you to request a refund for any reason.
In each case the product must be:
a) still sealed,
b) unused, and
c) in its original condition.
You will be refunded:
a) the price paid for the product, and
b) standard outbound delivery costs only (any additional delivery charges such as express or next-day delivery are non-refundable).

10 – Money-Back Guarantee (First-Time Purchase)
In addition to your right to a refund for unused goods as set out above, we offer a voluntary 30-day money-back guarantee on your first purchase of a 50ml Deodorant Balm or The Discovery Set (the “Guarantee”).
This Money-Back Guarantee is a promotional offer and is not a contractual or statutory entitlement.
It is provided in addition to, and does not replace, restrict or limit any rights you may have under applicable Australian Consumer Law / New Zealand Consumer Guarantees Act.
The Guarantee applies only to first-time customers purchasing a single 50ml Deodorant Balm or The Discovery Set.
The Guarantee does not apply to:
a) subscriptions,
b) bundles or gift sets,
c) limited edition products, or
d) delivery or return postage costs.
To make a claim, you must complete our Money-Back Guarantee claim form.
We ask that you use the product for a minimum of 14 consecutive days before submitting a Guarantee claim, unless you experience irritation or an adverse reaction.
Claims must be submitted within 30 days of delivery of the product.
The Guarantee applies even if the product has been opened or used, provided the conditions above are met.
Only one money-back guarantee claim per customer is permitted. Refunds are limited to the price paid for the qualifying product only.
Refunds will be processed once your claim has been reviewed and eligibility confirmed.
We reserve the right to modify or withdraw this Guarantee at any time, but this will not affect any valid Guarantee claim already submitted in accordance with these Terms.
11 – Subscriptions
11.1 How Subscriptions Work
If you purchase a subscription:
a) it renews automatically until cancelled; and
b) you can manage, pause, skip or cancel deliveries via your account.
11.2 Cancelling Your Subscription
You may cancel your subscription at any time.
Cancellation will apply to future shipments only. Any products that have already been paid for at the time of cancellation will still be delivered.
You can cancel your subscription either:
a) by logging into your customer account; or
b) by contacting our Help Centre for assistance.
11.3 Changes to Subscription Terms or Pricing
We will give you reasonable advance notice of any material changes to your subscription (including changes to pricing). You may cancel your subscription before any such changes take effect.
12 – Discount Codes & Promotions
From time to time, we may offer discount or promotional codes. Unless stated:
a) codes are single-use and non-transferable;
b) only one code may be used per order;
c) codes cannot be applied retrospectively;
d) codes have no cash value.
If an order using a discount code is refunded, the code will not be reissued.
13 – Referral Programme
From time to time, we may offer a promotional referral programme that allows existing customers (“Advocates”) to earn rewards by referring friends (“Referred Friend(s)”) to AKT.
Participation in the referral programme is voluntary and subject to the terms set out below.
13.1 Advocate Rewards
An Advocate may receive 15% off their next purchase for each Referred Friend who places a qualifying first order with AKT.
a) Rewards may be cumulative, subject to reasonable limits on the number and frequency of referrals to prevent misuse.
b) Advocate rewards will be issued 30 days after the Referred Friend’s qualifying purchase, provided that the purchase has not been cancelled or refunded during that period.
c) If a qualifying purchase is cancelled or refunded, any related Advocate reward that has not yet been used may be withdrawn or cancelled.
Where a reward has already been used, we reserve the right to take this into account when assessing eligibility for future referral rewards, including where we reasonably suspect misuse or abuse of the programme.
Advocate rewards:
a) are valid for 30 days from the date of issue;
b) cannot be exchanged for cash or cash equivalents;
c) cannot be combined with other discount codes, offers or promotions in the same order.
Advocate rewards may be used on:
a) single-item purchases; or
b) one subscription, excluding The Starter Set and The Discovery Set, subject to the exclusions below.
Where an Advocate applies a reward to a subscription:
a) the discount applies to one active subscription only; and
b) subsequent subscription renewals will revert to the standard price unless otherwise stated.
Advocate rewards are not valid on:

Advocates must be 18 years of age or older.
13.2 Referred Friends Discounts
Referred Friends may receive 15% off their first order with AKT.
To qualify:
a) the Referred Friend must be a new customer; and
b) the Referred Friend must be 18 years of age or older.
Referred Friend discount codes:
a) are valid for 30 days from the date of issue;
b) cannot be exchanged for cash or cash equivalents;
c) cannot be combined with other discount codes or promotions in the same order.
Referred Friend discounts may be used on:
a) single-item purchases; or
b) one subscription, excluding The Starter Set and The Discovery Set, subject to the exclusions below.
Referred Friend discounts are not valid on:

If a Referred Friend’s qualifying purchase is refunded or cancelled, any related Advocate reward may be withdrawn.
13.3 General Referral Programme Conditions
Referral rewards and discounts are promotional offers, not legal or contractual entitlements.
We may refuse, cancel or withdraw referral rewards or discounts where we reasonably believe that:
a) there has been misuse, abuse or gaming of the programme;
b) referrals are not genuine personal referrals;
c) incorrect or misleading information has been provided;
d) the programme has been used in breach of these Terms; or
e) an administrative or technical error has occurred.
We reserve the right to modify, suspend or withdraw the referral programme at any time. Any such changes will not affect referral rewards that have already been validly earned and issued in accordance with these Terms.
We are not responsible for referral codes that are expired, entered incorrectly, or not applied due to misuse or circumstances outside our reasonable control. If you believe a code has not applied due to a technical issue, please contact our Help Centre.
Relationship with other promotions: Referral rewards and discounts are subject to any additional restrictions or exclusions communicated at checkout or in promotional materials.
Nothing in this referral programme affects your statutory consumer rights.
14 – Competitions & Giveaways
From time to time, we may run competitions or giveaways. Unless stated otherwise:
a) entry is free and no purchase is required;
b) competitions are open only to eligible participants;
c) prizes are non-transferable and have no cash alternative.
Competitions are not sponsored or endorsed by social platforms unless explicitly stated.
15 – Intellectual Property
All content on the Website — including text, images, videos, designs, logos and branding — belongs to AKT or our licensors.
You may use the Website for personal, non-commercial purposes only.
You must not copy, reproduce, distribute or exploit our content without our written consent.
16 – Acceptable Use of the Website
You agree not to:
a) misuse the Website or interfere with its operation or security;
b) use automated tools (such as bots or scrapers) without permission;
c) use our content for commercial purposes without consent.
We may restrict access where the Website is misused.
17 – Marketing Communications
If you opt in to receive email or SMS marketing:
a) you can opt out at any time using the unsubscribe option provided;
b) opting out will not affect transactional or service messages.
Your personal data is handled in accordance with our Privacy Policy.
18 – Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any right, remedy or guarantee conferred on you by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or the New Zealand Consumer Guarantees Act 1993, or any other applicable consumer protection legislation that cannot lawfully be excluded or limited.
To the extent permitted by law:
a) we are not liable for any indirect, incidental, special or consequential loss, including loss of profit, revenue, opportunity, or data; and
b) our total liability to you for any loss or damage arising out of or in connection with an order will not exceed the amount paid by you for the product giving rise to the claim.
Where the Australian Consumer Law or the New Zealand Consumer Guarantees Act permits a supplier to limit its liability for goods, our liability is limited (at our option) to one or more of the following:
a) the replacement of the goods or the supply of equivalent goods;
b) the repair of the goods;
c) the payment of the cost of replacing the goods or acquiring equivalent goods; or
d) the payment of the cost of having the goods repaired where applicable.
This clause applies to the fullest extent permitted by law.
19 – Other Legal Terms
a) Third-party rights: these Terms apply between you and us only.
b) Severability: if any part of these Terms is found to be invalid, the rest remains effective.
c) No waiver: failure to enforce a provision does not waive our right to enforce it later.
d) Entire agreement: these Terms set out the entire agreement between you and us regarding your purchase.
20 – Governing Law & Jurisdiction
These Terms are governed by the laws of Australia or New Zealand, as applicable.
The courts of those jurisdictions have non-exclusive jurisdiction, subject to any mandatory consumer protection laws.
